Using Mobile phone while driving is common in today’s fast moving life, but it is widely considered dangerous due to its potential for causing distracted driving and accidents. Due to the number of accidents that are related using the mobile phone while driving like conducting calls on a phone, attending a call and texting, some jurisdictions have made the use of calling on a phone while driving as illegal.
If you plan to drive in Jodhpur then you need to be careful while driving. Rajasthan High Court has ordered that driving license of those who use the mobile phones while driving, should be cancelled.
HC Bench comprising of Justice Gopal Krishna Vyas and Justice Ramchandra Singh Jhala took into consideration submissions made by Advocate General which pointed to increasing road accidents due to use of mobile phones while driving.
HC stated that “The concerned R.T.O. and authorities of the Transport Department are directed to initiate the proceeding for cancellation of driving licence strictly in accordance with law and after providing an opportunity of hearing, cancel the driving licence.”
HC Bench thus expounded that,”Drivers of four and two-wheelers are usually using mobile while plying the vehicles, which is not permissible under the law. More so, due to said act of vehicle drivers, a number of accidents take place.”
The Rajasthan High Court on Friday directed the State Government as well as the Additional Police Commissioner-Traffic, Jodhpur to ensure that no vehicle driver uses a mobile phone while driving the vehicles.
The High Court bench issued the direction that,”If any vehicles drivers are found using mobile phones while plying vehicles, then after obtaining their photographs and other credentials of such vehicles drivers, the same may be forwarded to the concerned R.T.O. for cancellation of the driving licence of such erring person”.
The matter has now been listed on 22 May, with a direction to place a compliance report before the Court.
How you could be Breaking the Law
While driving, if you pick up or use any type of phone that must be held you will be breaking the law. This means you should not use your mobile phone:
- when you are stopped at traffic lights
- when you are queuing in traffic
- to make or receive calls
- to send or receive picture and text messages
- to access the internet
When driving or riding a vehicle, you should not use or be distracted by your mobile phone.
